1. Acceptance of Terms
By accessing or using www.TopCaliforniaLender.com (the 'Site') or submitting an application with Top California Lender ('we,' 'us,' or 'our'), you agree to these Terms and Conditions ('Terms'). If you do not agree, please do not use the Site or our services.
2. Services Overview
Top California Lender provides private lending for commercial real estate, offering non-recourse loans from $3M to $100M+ with fixed rates (9%-10.5%) and no prepayment penalties. Funding timelines (e.g., 8-day average) and loan approvals are subject to underwriting, market conditions, and applicant qualifications.
3. Eligibility
You must be at least 18 years old and a U.S. resident or entity to apply for a loan or broker partnership. We reserve the right to refuse service to anyone for any reason, per our discretion as a private entity.
4. Application Process
Loan and broker applications submitted via the Site are reviewed within 24-48 hours. Submission does not guarantee approval. You agree to provide accurate, complete information and, for loan applications, supporting documents (e.g., appraisals, financials) as requested.
5. Loan Terms and Conditions
Approved loans are subject to terms outlined in your loan agreement, including loan amount, term (6-60 months), interest rate (fixed, 9%-10.5%), and non-recourse status. Past performance ($1.3B funded, 420+ deals) does not guarantee future results. Private lending involves risks, including loss of capital.
6. Limitation of Liability
We are not liable for damages arising from your use of the Site or our services, including delays in funding, loan denials, or market changes. Information on the Site is for informational purposes only and subject to change without notice.
7. Governing Law
These Terms are governed by California law. Disputes will be resolved in courts located in the State of California.
8. Changes to Terms
We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms.
